Separation Agreements

Separation Agreements are a great way to deal with the breakdown of a marriage without having a costly Court litigation process. Separation Agreements are cost-effective and allow the parties to keep the negotiating power in their hands and out of the Court system. Some couples use a mediator to assist in coming to an agreement, and then seek a lawyer to draft a final agreement based on the Mediation Memorandum of Agreement.

Separation Agreements go into detail about the following, to name a few:

  • The Matrimonial Home
  • Property
  • The Children (Decision-Making (Custody) and Parenting-Time (Access)
  • Child Support
  • Spousal Support
  • Life Insurance to Secure Support
  • Equalization

The great thing about Separation Agreements is that they are customizable to your specific needs and requests. It is the best and most cost-effective way to deal with your family law matter, if both parties are amicable and willing to negotiate an agreement. If you and your spouse are not amicable, cannot stand to sit in the same room together and cannot agree on the simplest of things, this may not be the best route to take.

Parenting Agreements can be made if both parties consent to the terms, but essentially, they will assist you in navigating the next 15+ years of your co-parenting relationship with this other individual.
